Para ello debes realizar una búsqueda en el estado del arte para verificar que tu idea es novedosa. Con este primer paso podrás eventualmente ahorrar muchos costos a futuro, ya que tu idea en un examen de patentabilidad podrá verse afectada irremediablemente por un documento u otro medio de difusión que muestre que tu idea ya existía anteriormente.

Con los documentos más cercanos del estado de arte con tu idea, debes verificar si tu idea tiene carácter inventivo, mediante las siguientes preguntas:
-¿la combinación de dichos documentos del estado del arte, lograrían tu idea?
-¿ a partir de un documento de estado del arte y combinando con un aspecto de diseño de simple implementación de un especialista en dicho campo técnico, lograría llegar a tu idea ?
Si a las preguntas anteriores, no encuentras documentos del estado del arte que respondan dichas preguntas, entonces su idea es candidata a ser patentada.
Para formalizar su idea, donde sea el país que se presente, debes plasmarla en los siguientes documentos:
1._Memoria descriptiva.
2._Reivindicaciones.
3._Figuras y dibujos.
